Rape is defined as forcing another person to have sex without their consent or engaging in sexual intercourse with a person who is under the influence of a substance or liquid, rendering the victim unable to provide consent. In Mississippi, rape is punishable by potentially life imprisonment, depending on the circumstances of the case.

Individuals who engage in sexual activity with a minor under 16 years of age can be charged with statutory rape. If the alleged victim is between the ages of 14 and 15 and the defendant is over 18 years of age (but not 21), then a conviction results in a maximum five-year prison term and a fine no more than $5,000. If the defendant is over 21 years of age, then statutory rape is punishable by a prison sentence of up to 30 years and a fine not exceeding $10,000.
